By creating an account on or otherwise using nod. ("the Service"), operated by Mesper SH.P.K. ("we", "us", the "operator"), you agree to these Terms of Service. 3. Accounts & eligibility

You must provide accurate account information and keep it up to date. You are responsible for safeguarding your credentials and for all activity under your account. The Service is intended for business use by users who are at least 18 years old (or the age of majority in their jurisdiction). You are responsible for the conduct of any team members or guests you invite.

4. Plans & pricing

nod. is offered on the following plans:

  • Free - limited usage at no charge.
  • Pro - €79 / month (or the equivalent annual price).
  • Agency - €199 / month (or the equivalent annual price).
  • Enterprise - custom pricing arranged directly with us.

Prices are shown in EUR and are exclusive of any applicable taxes or VAT, which are added at checkout where required. Paddle localises and may display prices in your local currency. 5. Billing - Paddle as Merchant of Record

Paid plans are sold and processed by Paddle.com Market Ltd ("Paddle"), our authorised reseller and Merchant of Record. This means Paddle, not nod., is the seller of record for your purchase. Paddle handles checkout, payment processing, invoicing, and the calculation, collection, and remittance of sales tax / VAT.

Your purchase is therefore also subject to Paddle's buyer terms. Card and payment details are entered with and handled by Paddle; nod. never receives or stores your full card data. Your charge may appear on your statement referencing Paddle.

6. Subscriptions, cancellation & refunds

Paid subscriptions renew automatically at the end of each billing period (monthly or annual, depending on your plan) at the then-current price until cancelled. You may cancel at any time; cancellation takes effect at the end of the current billing period and you retain access until then. We do not provide pro-rated refunds for partial periods except as set out below or as required by law.

You may request a refund within 14 days of an initial purchase or renewal, consistent with EU/UK cooling-off rights for digital services. 7. Acceptable use

You agree not to:

  • Upload or share illegal, harmful, deceptive, or infringing content.
  • Use the Service to spam, harass, or impersonate others.
  • Attempt to reverse-engineer, scrape, overload, or circumvent security or access controls.
  • Resell or provide the Service to third parties except as expressly permitted by your plan.
  • Share account credentials with unauthorised parties.

We may suspend or limit accounts that abuse the Service, including abuse of AI features (see section 9), to protect the Service and other users.

8. Your content & intellectual property

You retain ownership of all content you upload (images, videos, copy, and other materials). You grant us a limited, worldwide, non-exclusive licence to host, store, process, and display that content solely to operate and provide the Service to you and the people you share it with.

We retain all rights in the Service itself, including its software, design, and trademarks. No rights are granted other than as expressly set out here.

9. AI features

Some features use third-party AI providers (currently Google's Gemini API) to generate suggestions from inputs you provide, such as briefs and prompts. As between you and us, you own the inputs you submit and the resulting outputs, to the extent such outputs are protectable and subject to the providers' terms. Your prompts and related inputs are processed by the AI provider to return a result.

AI output may be inaccurate, incomplete, or unsuitable for your purpose. It is provided without warranty; you are responsible for reviewing it before use. AI features are subject to fair-use and anti-abuse limits, and we may rate-limit or restrict access to prevent excessive or automated usage.

10. Meta integration

If you connect a Meta (Facebook / Instagram) ad account to publish approved creatives, you are responsible for that ad account and for complying with Meta's terms, advertising policies, and platform requirements. We act only at your direction to publish the assets you approve. We are not responsible for Meta's decisions, ad review outcomes, account actions, or service availability. You may disconnect the integration at any time.

11. Data & privacy

Our handling of personal data is described in our Privacy Policy. We process personal data in accordance with the GDPR. Payment data is handled by Paddle as Merchant of Record and is never seen or stored by nod.

12. Disclaimers & limitation of liability

The Service is provided "as is" and "as available", without warranties of any kind except those that cannot be excluded by law. We do not warrant that the Service will be uninterrupted, error-free, or fit for a particular purpose.

To the maximum extent permitted by law, the operator shall not be liable for any indirect, incidental, special, or consequential damages, or for lost profits or data. Our total aggregate liability arising out of or relating to the Service shall not exceed the amounts you paid for the Service in the 3 months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot lawfully be limited.

13. Termination

You may stop using and delete your account at any time via your account settings or by contacting hello@usenod.io. We may suspend or terminate accounts that violate these Terms or that we are required to act on by law. 14. Governing law
